RESERVATIONS AND PAYMENT TERMS

Reservations are accepted online and by phone. A deposit equal to 50% of the reservation is due and payable to Lifestyles Property Services at the time of booking your reservation. A credit card is required for the initial deposit. Credit card fees do apply. (3% for VISA, MC, Discover and 4.5% AMEX) Full payment is due 30 days prior to arrival date. Reservations made within 30 days of arrival date will require payment in full at time of booking.

CANCELLATION POLICY
If a cancellation occurs within 30 days of your date arrival, any monies previously collected will not be refunded. If you cancel outside of 30 days we will refund your money less (the greater of) $300 or 10% of the total rental contract amount. Accordingly, we highly recommend all our guests purchase the Travel Insurance offered in the case of any unforeseen circumstances and weather related cancellations. Under certain circumstances we can roll a deposit into another rental season but this is done on a case by case basis. We do not make any refunds due to weather related cancellations. However, in the event a hurricane WARNING is issued by the National Hurricane Center for the Jacksonville Area within 5 days before the scheduled arrival date, the Guest may call in advance to cancel their reservation without any cancellation fees and all monies paid (less the $70 Accidental Damage Waiver) will be refunded in full.

DAMAGE WAIVER VS SECURITY DEPOSIT
All rental homes require a security deposit to cover the cost of damages, missing items or other problems that may occur during your stay. By choosing this option a refundable deposit of $1500.00 will be added to the reservation payment. This is in addition to the rental cost and a 3% fee will be added if paying by credit card (4.5% if using AMEX). Your deposit will be held in a non-interest bearing escrow account. All deposits will be refunded providing no damage has been found. This will be made payable to the Guest listed on the agreement within 15 days of your departure date.

As an alternative, Lifestyles Vacations Rentals offers an optional Damage Protection Fee, in lieu of a security deposit. If you choose the non-refundable $70.00 Damage Waiver fee this damage waiver covers up to $3000 for accidental or inadvertent damages in the vacation rental home. Please be advised that intentional damage or gross negligence will result in additional costs. This $70.00 fee is charged within your reservation. The home will be inspected after departure and any damages or additional cleaning required will be reported to us within 72 hours. We will then contact you to inform you of any additional charges that may arise as a result of the inspection of the vacation home. The credit card on file will be charged for any additional charges that are due. If you choose to pay this fee, it will be added to your reservation payment.

TRAVEL INSURANCE
Lifestyles is proud to offer our guests one of the best vacation rental protection policies in the industry. CSA Travel Protection All Seasons Travel Plan can cover you and your vacation investment if and when the unexpected happens.

The policy costs 6.95% of your total room reservation and we recommend you purchase the insurance at the time of booking to ensure the best coverage. CHECK-IN and CHECK-OUT TIMES
Check-in time is no earlier than 3:00 pm on your day of arrival. Should you request an earlier check-in time, it can be requested either during the booking process by adding the option of the Early Check-In Fee, or at the time of booking over the phone, and if the vacation home is available, early check-in can be confirmed for a fee of $50.00 plus tax.
Check-in time 10:00 am. If you are still in the vacation home when the cleaners arrive shortly after 10am, you will be charged an additional nights rent. You will still be required to vacate the vacation home immediately so it can be prepared for the next guest. Late check-out can be requested either during the booking process by adding the option of the Late Check-Out Fee, or at the time of check-in, and if the vacation home is available, late check-out can be confirmed for a fee of $50.00 plus tax.


UPON CHECK-IN
Please inspect the vacation rental and phone in any damages or concerns that you may find. Please call 904-853-6386 or 1-904-329-5910. If you are calling after office hours please leave a message and we will return your call on the next business day.

EARLY DEPARTURE
Once you have checked in, should you need to leave the vacation rental home prior to your originally scheduled check out date and time, there will be no refund.

CLEANING FEE AND SERVICES
All properties require a non-refundable departure cleaning fee to be paid at time of booking. Our properties are professionally cleaned prior to your arrival and after your departure. Tenants shall maintain the premises in a good, clean and habitable condition and use the premises in a careful and lawful manner.  Failure to do so will result in an additional fee assessed to the credit card on file.  While linens and bath towels are included with your rental, daily maid service is not. If you are interested in mid-stay cleaning services, we can provide for an additional fee. Prior to departure we ask our guests to clean all dishes (run the dishwasher), light vacuum or broom the floors, remove trash to the exterior trash receptacles and place dirty linens and towels on washer. 

NON-SMOKING
All vacation rentals are non-smoking and non tobacco use. Evidence of smoking/chewing tobacco or drugs inside the property will result in immediate eviction and forfeiture of all amounts paid and will result in an additional $500 fee to guest as excessive damage cost that will be charged to the credit card on file.

PET-FRIENDLY HOMES
Lifestyles does offer some pet-friendly homes. Pet friendly homes will be identified in the property description. If you wish to bring your pet, this must be specifically requested at the time of reservation by adding the non-refundable pet fee to your reservation. If unauthorized pets are discovered to have been in a vacation rental during a stay, a $500 fee will be charged to the credit card on file for additional cleaning upon departure.

HOA Rules
 Tenant has been provided a copy of the Rules and Regulations and will comply with all rules. Any fine or violation caused by the tenant from the Association will be the tenant responsibility to pay and correct.

PARKING
Our rental properties prohibit the onsite parking of recreational vehicles, personal watercraft (boats, trailers, jet skis, etc.) and/or do restrict the number of vehicles per rental unit. Most rentals can accommodate two vehicles but some units are limited to one. Please note the parking restrictions in the property description. From time to time a garage may become unavailable.

KEYS
Our office is conveniently located at 586 Marsh Landing Parkway, Jacksonville Beach, FL 32250 right off JTB & A1A and directly between the Publix and Target. Our office is open until 6:00pm weekdays and 4:00 on weekends. Please contact us if you will be arriving late to make other arrangements. We do ask that you provide as much advance notice as possible. Upon departure we ask you to return the keys to our office. If we are not in the office you may put them in the mail slot. In the unlikely event that you lock yourself out, there will be a $50 service fee during normal business hours and a $100 service fee after business hours. The charge for a lost key is $75.00.

LIABILITY
This vacation rental is privately owned and the management company and/or owner reserve the right to refuse services to anyone. The homeowner and/or Lifestyles will not be held liable for any accidents or injury to guests while staying in the vacation rental. Nor will the homeowner and/or Lifestyles Realty be held liable for the loss of money, jewelry, valuables or other possessions of any kind. Lifestyles or the owner shall not be liable in respect of loss or changes caused by force majeure e.g. Strikes, Fire, Flood, Closure of Airports, Weather Conditions, War, Riots, Terrorist Activity, construction or any other event beyond our control.

SECURITY 
Tenants shall see to their own security while in the property by locking doors,windows,
garage doors, etc. Valuable items (as reasonably determined by Lifestyles Property Services) left behind by the Tenants will be held for no longer than two months and a reasonable effort will be made to contact the tenants for return. If the item(s) are not claimed within the time frames noted they will become the property of the Landlord and or disposed of. Landlord shall not have any security responsibilities for areas covered in this Agreement. Tenant shall always remember to lock any door of a garage or storage unit and any door between a garage and the dwelling. When leaving, Tenant shall make sure to lock all doors and deadbolt locks.


NO DANGEROUS ITEMS 
Items that pose an environmental hazard or a risk to the safety or health of other residents, occupants, or neighbors in Landlord’s sole judgment or that violate any Applicable Laws may not be stored. Prohibited items include fuel (other than in a properly capped fuel tank of a vehicle or a closed briquette lighter fluid container), fireworks, rags, piles of paper, or other material that may create a fire or environmental hazard. Landlord may remove from such areas, without prior notice, items that Landlord believes may constitute a fire or environmental hazard. Because of carbon monoxide risks, Resident shall not run the motor of a vehicle inside a garage unless the garage door is open to allow fumes to escape.

MAXIMUM GUESTS PER HOME
The number of guests allowed in a vacation rental home is determined by the Florida Fire Code and must be adhered to or you will be asked to vacate the vacation rental. The registered guest and parties on this Agreement are the only overnight guests allowed in the property.

SUPPLIES
An initial supply of paper products, soap, dishwasher detergent, laundry detergent and basic cleaning supplies are provided in the properties.

FURNITURE AND DECOR IN THE HOME
Our vacation rentals are furnished and decorated by the owners. Please DO NOT rearrange the furniture or decor items, DO NOT take any items outside that are part of the interior decor. Guest will be charge a fee of $150 to the credit card on file. Property Manager is not responsible for any changes in furniture or any missing furniture that may occur. Guest expressly agrees to indemnify owner for any damages or costs to the premises, furnishings, equipment and household items therein that occur during the guest occupancy.

AMENITIES, POOLS, HOA CONSTRUCTION, EXTERIOR NOISE
On occasion a property owner or Homeowners Association (HOA) may find it necessary t close a pool, beach access path, fitness facilities, or any other amenities for repairs or maintenance. Lifestyles is not responsible for the operation, closure, construction or malfunction of amenities. Lifestyles is not responsible any noise disturbance from any other units or homes close by your rental. Lifestyles is not responsible for contraction or maintenance that is being done by the HOA. No rental adjustments or reimbursements will made as a result of these conditions.

REPAIRS AND MAINTENANCE
Please report any damage you notice to our office by phone at 904-853-6386 or by email at [email protected] when you check in to avoid getting charged for damage you didn't create. All maintenance issues must be referred to the Lifestyles Property Services please send requests to [email protected] Tenants are not authorized to order maintenance or perform any repairs. All maintenance requests must be emailed to [email protected]  We will respond in a timely manner and send the proper repair company in a timely fashion.  If a repair is not an emergency and happens on a weekend all repairs will then be taken care of the following business day.

CAUSE FOR EVICTION
The guest and all parties with the guest will be subject to immediate eviction from the property is the guest or parties of the guest violate any terms of this Agreement. Cause for eviction includes but is not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking. In the event of eviction from the property, the guest shall forfeit all amounts paid and there will be no refund of money.

ATTORNEY'S FEES AND LEGAL COSTS
In the event Lifestyles must bring action to enforce any provision of this agreement, declaratory or otherwise, the guest agrees Lifestyles shall be entitled to collect any award, judgment or decree of any court, arbitrator or other forum’s presiding officer, and Lifestyles will be entitled to recover its full costs and disbursements together with, without limitation, its full attorney's fees, arbitrator's fees, mediation fees, expert witness’ fees, discovery costs, deposition costs, investigation costs, other legal expenses and all other related expenses incurred in connection with such dispute and any proceeding relating to such dispute, regardless of the amount the court, arbitrator or other forum’s presiding officer may adjudge reasonable at trial, arbitration, proceeding, on any appeal of such suit, action, arbitration or other proceeding, and in any bankruptcy proceeding.

RADON GAS
 In accordance with the requirements of Florida Statutes Section 404.056(5), the following notice is hereby given to Tenant:

Radon is a naturally occurring radioactive gas that, when it has accumulated in a
building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county health department.


SHORT TERM RENTALS
It is expressly understood and agreed that this is a short term vacation rental under the provisions of Chapter 509, Florida Statutes, and is not a lease or other long term residential tenancy agreement. This Agreement is only for the licensed use of the property for the stated term. It creates no property rights for guest and no rights of renewal or for recurring usage. This Agreement is also neither a Time Share sale or a Vacation Club.

If the property you've booked should become unavailable for any reason, we will make every effort to move you into a similar vacation rental.
